These Terms of Service ("Terms") govern your access to and use of Websterish (websterish.com) and related services (collectively, the "Services") operated by Gizbee, LLC ("Gizbee," "we," "us," or "our"). By accessing or using Websterish, you agree to be bound by these Terms.
You must be at least 18 years of age, a resident of, and reside within the United States to use Websterish. By using Websterish, you represent that you meet these requirements. Websterish is not intended for users outside the United States.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
You retain ownership of content you create and submit through Websterish. By submitting content, you grant Gizbee a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and providing the Services.
You are solely responsible for your content and represent that you have the necessary rights to submit it. You agree not to submit content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable.

We reserve the right to suspend or terminate your account and access to Websterish at any time, with or without cause, and with or without notice. You may also delete your account at any time by contacting us. Upon termination, your right to use the Services will immediately cease.
You agree to indemnify, defend, and hold harmless Gizbee, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of Websterish; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit through Websterish.
We respect the intellectual property rights of others and expect users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of alleged copyright infringement.

We may terminate the accounts of users who are determined to be repeat infringers.
The Services and their original content (excluding user content), features, and functionality are owned by Gizbee, LLC and are protected by applicable intellectual property laws. "Gizbee" and "Websterish" are trademarks of Gizbee, LLC.
Websterish may integrate with or rely on third-party services, including communications platforms and cloud infrastructure providers. Your use of any third-party service is subject to that provider's terms and privacy policy. We are not responsible for the practices or content of any third-party services.
Websterish is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that Websterish will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Gizbee shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Websterish.
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.
Arbitration Agreement. You and Gizbee agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Websterish will be resolved by binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible. There is no judge or jury in arbitration, and court review of an arbitration award is limited.
Arbitration will be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitration will take place in Washington State or, at your election, may be conducted remotely. Each party will be responsible for their own arbitration fees except as required by AAA rules or applicable law.
Class Action Waiver. You and Gizbee agree that any proceedings to resolve disputes will be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you and Gizbee each waive any right to a jury trial.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to inquire@gizbee.com within 30 days of first accepting these Terms. If you opt out, you and Gizbee may pursue claims against each other in court.
We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. It is your responsibility to review these Terms periodically for changes. Your continued use of Websterish after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using Websterish.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by Gizbee to be effective.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.
By using Websterish, you consent to receive communications from us electronically, including by email and SMS (where you have opted in). You agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
If you provide us with feedback, suggestions, or ideas about Websterish, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate that feedback into our Services without any obligation or compensation to you.
These Terms, together with our Privacy Policy , constitute the entire agreement between you and Gizbee regarding your use of Websterish and supersede any prior agreements.
